CHARTER TERMS AND CONDITIONS
1. If children will be embarking, the LESSEE must inform the LESSOR at least 1 day in advance so that life jackets appropriate to the children’s ages can be arranged.
2. The contract shall only be considered valid once the full charter amount has been received, unless otherwise agreed in writing.
3. Cancellation of the contract shall be subject to the following penalties:
3.1 Day Charters:
- More than 30 days before the start of the charter: 25% of the total charter price.
- Between 30 and 7 days before the start of the charter: 50% of the total charter price.
- Less than 7 days before the start of the charter, or in the event of a no-show: 100% of the total charter price.
3.2 Overnight Charters:
- More than 60 days before the start of the charter: 25% of the total charter price.
- Between 60 and 30 days before the start of the charter: 50% of the total charter price.
- Less than 30 days before the start of the charter: 100% of the total charter price.
4. It is strictly forbidden to bring weapons, illegal drugs, contraband, or any illegal substances on board, or to engage in any unlawful activity, including but not limited to illegal commercial activity, unauthorised regattas, or commercial fishing.
5. Any misuse of the vessel’s safety equipment shall be the sole responsibility of the LESSEE.
6. The use of water toys and accessories, including but not limited to sea scooters, paddle boards and sea bobs, shall be entirely at the LESSEE’s own risk and responsibility. The LESSOR shall not be held liable for any accident, injury or damage arising from their use.
7. If the LESSEE requires professional assistance outside the port due to negligence in the use of the vessel or lack of knowledge regarding its operation, and provided that no damage has been caused to the vessel, the LESSOR may deduct an additional charge equivalent to 50% of the daily charter price from the security deposit.
8. Where the vessel has been chartered with a skipper provided by the LESSOR, the LESSEE shall not be held liable for navigation or operational matters under the skipper’s control. However, the LESSEE shall remain liable for any damage caused by negligent or inappropriate behaviour on board, including but not limited to burns to upholstery caused by cigarettes or any dangerous conduct that may require the charter to be terminated and the vessel to return immediately to port.
9. Certain vessels are subject to a security deposit, which shall serve as a guarantee against any loss, damage or deterioration occurring during the charter and attributable to the LESSEE. This includes, without limitation, burnt upholstery, accidental or intentional damage to any part of the vessel, and any other damage caused during the charter period.

- Lagoon 38 (Niu Tribe): €500
- Invictus 280 (Kulu): €300
BAREBOAT CHARTERS / CHARTERS WITHOUT SKIPPER
1. The LESSEE shall pay a security deposit of €2,000 on the day of embarkation. The deposit shall be returned once the inventory and condition of the vessel have been checked. If inspection cannot be carried out immediately upon return to port, the LESSOR shall have a maximum of three days to complete the inspection and return the corresponding balance of the deposit.
2. Fuel: The vessel shall be delivered with a full tank. The LESSEE must return the vessel with a full tank or pay for the fuel consumed at the end of the charter. If the vessel returns after the fuel station has closed, or if refuelling cannot be completed, the fuel consumed shall be charged based on a reasonable estimate using the applicable port fuel price as reference.
3. By signing the charter contract, the LESSEE declares that he/she holds the licence legally required to operate the vessel and has sufficient knowledge and experience to do so safely and correctly.
4. Procedure in the event of an accident: If the LESSEE or any passenger suffers an accident on board, the LESSEE must immediately notify the LESSOR and provide a written accident report stating the causes, circumstances and consequences of the incident, together with the names and addresses of any persons involved, witnesses and injured parties, where known. For the purposes of this contract, an accident shall mean any sudden, external, involuntary and unforeseen event affecting any person on board the vessel.
5. The LESSEE shall be responsible for any damage caused to the vessel that is not attributable to a third party, as well as for any loss, theft or breakage of equipment included in the vessel’s inventory. In the event of damage, loss or theft affecting the vessel or any of its equipment or components, the LESSOR may retain all or part of the security deposit and deduct the cost of replacement, repair or reinstatement.
6. The vessel must be returned to the same place of departure unless otherwise expressly agreed. Any delay shall incur an additional charge of €100 per hour. If the vessel is returned to a different location without prior authorisation, the LESSEE shall be responsible for all resulting costs, including but not limited to transport, fuel, crew expenses, subsistence and any other related costs.
7. If, prior to departure or during the charter, the LESSOR determines that the LESSEE is handling the vessel improperly, unsafely, or in a manner that presents a risk, the LESSOR may cancel or terminate the charter. In such case, 50% of the booking amount shall be retained. Alternatively, the LESSOR may offer the services of a professional skipper for €180 plus VAT.
8. The vessel must not navigate more than 10 nautical miles from the coast of Ibiza and Formentera. Any breach of this limit may result in immediate termination of the charter and a contractual penalty of €2,000.
9. The LESSEE shall be solely responsible for any fines, penalties, administrative sanctions, civil liabilities or criminal liabilities arising from failure to cooperate with the authorities or from any infringement or unlawful conduct during the charter period.
10. The LESSEE acknowledges having been informed of dangerous navigation areas and undertakes not to navigate near them. The LESSEE must also use the vessel’s navigation chart and onboard equipment at all times to avoid shallow areas, rocks, reefs or other hazards. Any damage resulting from failure to do so shall be the sole responsibility of the LESSEE.
RULES FOR NAVIGATION AND USE OF THE VESSEL
1. It is forbidden to navigate at more than 3 knots inside ports and within 200 metres of beaches.
2. It is forbidden to navigate within 50 metres of the coastline, except where strictly necessary, and in such cases the maximum speed shall be 3 knots.
3. It is forbidden to anchor on rocky seabeds.
4. It is forbidden to beach the vessel or leave it on the shore.
5. It is forbidden to navigate near swimmers, spearfishers, freedivers or snorkellers. A minimum distance of 50 metres must always be maintained.
6. In the event of any emergency, breakdown or delay, the LESSEE must contact the telephone numbers provided by the LESSOR before activating any rescue or towing service, unless immediate emergency assistance is strictly necessary for safety reasons.
7. It is forbidden to carry more than 12 persons on board, including the skipper, or more than the maximum number of persons legally authorised for the specific vessel, if lower.
8. The LESSEE must use the vessel with due care, as if it were his/her own property, and must keep it in good condition at all times.
9. The vessel may not be left moored or anchored in unprotected waters without any person remaining on board.
10. The vessel must not be operated by any person under the influence of alcohol, drugs, narcotics or any other substance affecting their ability to navigate safely. Illegal substances are strictly prohibited on board.
