All boats offered by Sea Charter Ibiza have a rental license, insurance and safety equipment.
The different owners of the boats offered by Sea Charter Ibiza establish the conditions of the rental. The specifications are detailed in the PDF files for each boat, which are downloadable. The ignorance of a rule does not exempt from its fulfillment and responsibility.
2. Confirmation of reservation
Reservations are only effective once payment of the 50% of the total cost has been received and you have the confirmation from Sea Charter Ibiza. If you do not receive confirmation from Sea Charter Ibiza within 4 hours, please contact the agency.
3. Terms of payment
The service is contracted by paying 50% of the total cost at the time of booking and the remaining 50%, before boarding.

Fuel consumption is not included in the price. Fuel payment will be made as specified by the boat owner. The fuel will be collected at the end of the rental day in two possible ways: According to hours of navigation. The amount corresponding to the expense at the gas station.
6. Cancellation policy
If the lessee, for any reason, cancels this contract, will have to pay the lessor the following percentages of the total amount of the contract: More than one month before the start date, 25%; with less than a month and up to seven days before the start date, 50%; less than 7 days before the start date, 100%.
7. Base port
The boats offered by Sea Charter Ibiza have assigned base port. The mooring outside port is not included in the price and is subject to an extra charge.
8 Departure and return times
The rental service lasts, in most cases, 8 hours. The service will be usually done between 10:00 am and 8:00 p.m., without exceeding in any case the daytime schedule.
9. Maximum capacity
According to current regulations, in Spain the maximum capacity of a boat or yacht, regardless of its length, is: maximum 12 people IN yachts, if your license allows, a maximum of 12 people plus crew.

General conditions of reservation
GENERAL RENTAL CONDITIONS
1. This contract is valid only for navigation within 12 nautical miles of the coasts of Ibiza and Formentera, and requires return of the vessel to the port before sunset. In the event of a later return, the lessee shall forfeit the entire security deposit and shall be subject to a penalty of €100 for each hour of delay.
2. It is the intention of the lessor to provide the vessel for charter, and it is the intention of the lessee to accept it for charter, both parties acting in good faith.
3. Any false statement or misrepresentation by the lessee in any of the specific provisions of this Agreement shall result in its immediate cancellation, and the lessee shall forfeit all amounts paid.
4. This Agreement shall not be valid until the lessor has received the agreed reservation payment, provided that such payment is made before the date specified in this document.
5. Prior to delivery of the vessel, the lessor must have received full payment of the agreed price, as well as the corresponding security deposit, in the case of charter without a professional skipper. Payment may be made by instant bank transfer, card payment, or cash.
6. In the event that the lessee cancels this Agreement, the lessor shall be entitled to charge the following percentages of the total contract amount: more than one month prior to the start date, 25%; less than one month and up to seven days prior to the start date, 50%; less than 7 days’ notice, 75%; and less than 24 hours prior to the start date, 100%.
7. The lessor undertakes to deliver the vessel in good working order and clean, at the agreed place, date, and time. In the event that, due to force majeure, such as a possible breakdown of the vessel, delivery cannot be made, the lessor undertakes to inform the lessee and to use all possible means to resolve the issue and/or to attempt to provide another vessel of equal or higher category. In the event that the agreed conditions cannot ultimately be fulfilled, the lessor shall refund all amounts received. The lessee undertakes not to make any additional claim.
8. The lessee shall use and care for the vessel received and all its accessories in accordance with good seamanship practices and shall take all necessary measures to prevent loss, accidents, or damage. In the event that towing is required due to reasons attributable to the lessee, including but not limited to running out of fuel, navigation in shallow waters or restricted areas, damage to the vessel, etc., a penalty clause of €3,000 shall apply, in addition to any claim for the cost of any damage or repairs suffered by the vessel.
9. If the lessor observes during the rental period that the skipper performs dangerous manoeuvres and/or shows evidence of inexperience, it may terminate the charter agreement early, refunding the lessee 50% of the rental price for the unused days, with no refund for the day on which the cancellation occurs. Alternatively, the lessee may request the service of a professional skipper, which may be provided by the lessor provided that it is able to arrange such service.
10. In the event of an accident or breakdown, the lessee shall contact the lessor by telephone as soon as possible. If this is not possible and immediate assistance is required, the lessee shall act in accordance with good seamanship practices, prioritising the safety of the persons on board and of the vessel. In the event that the breakdown is not due to misuse by the lessee and cannot be resolved within a short period of time, the lessor shall refund the lessee the proportional amount of the rental fee corresponding to the unused period, without the lessee being entitled to make any claim for damages or losses. Nevertheless, the lessor shall make all possible arrangements to find another vessel so that the lessee may continue the charter.
11. The vessel is covered by an insurance policy, with coverage for accidents, including both damage to the vessel itself and civil liability and occupants, subject to the limitations specified in the general and specific conditions of the policy.
12. In the event of a claim and if, for any reason, the insurance company does not cover all or part of the damages, costs, or civil liability, the lessee shall be liable for all such amounts, releasing the lessor from any liability.
13. Any delay in the return of the vessel on the agreed day and at the agreed time shall be subject to a penalty of €100 per hour of delay, payable by the lessee to the lessor. In the event that the vessel is left at a location other than the one agreed, the lessee shall be liable for all costs, damages, and losses arising from this.
14. In the event that children are to be on board, the lessee must notify the lessor in advance so that adult life jackets may be replaced with those appropriate for their size.
15. The security deposit received by the lessor prior to boarding serves as security for any damage, loss, theft, or any item not covered by the insurance company, or for delays in the return of the vessel. However, if the amount resulting from any of the aforementioned cases exceeds the amount of the security deposit, the lessee shall be obliged to pay the difference. The security deposit shall be returned to the lessee once the condition of the vessel has been checked and any necessary repairs have been carried out.
16. At the time specified in this Agreement for the return of the vessel, the lessee and all persons on board must have disembarked, leaving the vessel ready for inspection by the lessor.
17. Provisioning costs, fuel, mooring fees, and crew, where applicable, shall be paid by the lessee. Mooring at the port of departure is included in the price. Fuel consumption costs shall be calculated based on the vessel’s fuel consumption per hour of navigation, using data provided by the vessel’s tracking system or in accordance with the costs set out in the commercial specification sheet of the rented vessel, which indicates fuel costs according to the route taken. In the event of a malfunction of the tracking system, navigation time shall be determined by the professional skipper or by the port staff responsible for receiving the vessel at the end of the day. The lessee acknowledges having been informed of the vessel’s fuel consumption.
18. The lessee acknowledges having been informed about the use of vessel tracking systems installed on the vessel, which are used for the purposes of providing assistance or support, preventing entry into or anchoring in prohibited areas, or calculating fuel consumption.
19. It is strictly prohibited to bring on board weapons, narcotics, any form of contraband, goods, fare-paying passengers, or animals, as well as to participate in regattas, commercial fishing, or any activity prohibited by applicable law.
20. Any costs arising from the misuse of safety equipment and systems (flares, life jackets, etc.) shall be at the lessee’s expense.
21. Subcontracting or subletting is not permitted. The lessee undertakes to use the vessel solely for themselves, their family members, or friends, provided that the total number of persons does not exceed the maximum authorised capacity for which the vessel is certified. Likewise, embarkation and disembarkation outside the port and at times different from those stipulated in this Agreement are not permitted, and this shall constitute grounds for cancellation of the charter without any refund of the amounts paid.
22. In the event of non-compliance with the rules established by maritime and/or customs authorities, the skipper shall be primarily responsible, with the lessee being secondarily responsible, expressly releasing the lessor from any liability. In the event that, due to causes attributable to the lessee, the skipper, or the crew, the vessel is detained or sealed by any authority and, as a result, it is not returned to the lessor on the date specified in this Agreement, the amounts payable by the lessee to the lessor for delay as set out in Clause 13 shall apply. Any fines received by the lessor in relation to the use of the chartered vessel during the charter period shall be paid by the lessee.
23. The lessee acknowledges having been informed of the areas considered dangerous and undertakes not to navigate near them, which shall constitute grounds for the application of the penalty clause equivalent to the total amount of the security deposit as set out in this clause. The following are recognised as dangerous areas: “es Freu Mitja and es Freu Petit”, “Sa Barqueta”, “es Gorrinets”, “es Pas”, “Illa d’es Porcs”, and the passage between “Illa d’es Bosc”, “Sa Torreta”, and “Cales de Compte”.
24. In the event that payment by the lessee is made using a credit or debit card that does not belong to the European Union or is an American Express card, an additional charge of 2.5% of the total rental price shall apply. For payments made with cards issued within the European Union, an additional charge of 1.5% shall apply.
25. The lessee acknowledges and accepts that the use of recreational nautical toys, such as seabob, paddle surf boards, torpedoes, among others, whether owned by SEA CHARTER IBIZA Y GESTIÓN S.L.U. or supplied by third parties through it, is carried out under their sole and exclusive responsibility. Neither the lessor nor the captain or skipper of the vessel (if present) shall in any case be liable for any personal injury, material damage, or any other harm that may arise from the improper, negligent, or inappropriate use of such equipment by the lessee, their companions, or any other person on board. The lessee declares having received the basic instructions for use and the corresponding safety rules, and undertakes to use such equipment in accordance with these instructions. Likewise, the use of nautical toys shall only be permitted in authorised and safe bathing areas where their use is not expressly prohibited. In the event of damage, accidents, or claims arising from the use of this equipment, the lessee agrees to assume full responsibility, expressly releasing SEA CHARTER IBIZA Y GESTIÓN S.L.U., the captain or skipper (if any), and the external supplier, from any claim, damage, or loss.
26. Rentals may be extended subject to the captain’s approval at a cost of €100 plus 21% VAT per hour, and must always return before sunset.
27. The Parties agree that any dispute, controversy, or claim arising out of or in connection with the performance or interpretation of this Agreement, or relating to the charter specified herein, shall be finally settled by arbitration under the Arbitration Court of the Official Chamber of Commerce of the Balearic Islands, which shall be responsible for the administration of the arbitration proceedings and the appointment of arbitrators, in accordance with its rules and regulations. The Parties expressly undertake to comply with the arbitral award rendered.
