General conditions of reservation
Once the CHARTERER has checked the condition of the boat, the fuel and other expenses that may have been incurred during the charter. THE HIRER undertakes to return the boat to THE CHARTERER with a full tank of fuel or to pay the difference + in the event that the boat has been rented WITHOUT A SKipper - THE PENALTY FOR FAILURE TO REFUEL WILL BE ..............,-€. For each hour of delay in the delivery of the boat.
PROVISIONS :
FIRST: THE HIRER undertakes to use the rented vessel as if it were his own property, in accordance with the rules of good seamanship, and with respect to the rules of the Marine Command. The HIRER is obliged to maintain the rented boat and all the installations on it in a good state of use.
The HIRER undertakes to carry on board the rented vessel only the authorised number of persons. The vessel that is the object of this contract shall be used for recreational navigation, and may not be used for commercial or lucrative operations.
THE HIRER undertakes not to take part with the vessel that is the object of this contract in any regatta or sporting competition. The vessel shall only sail within Spanish jurisdictional waters.
THE HIRER undertakes not to leave the vessel moored or anchored, without any person on board, in roadsteads or unprotected waters and which do not require payment of mooring fees.
THE HIRER undertakes not to steer the vessel subject to this contract under the influence of alcoholic beverages, toxic or narcotic drugs, nor to embark illegal substances.
The HIRER is responsible for any damage or harm caused to the rented boat, due to causes not attributable to third parties, and for the loss of any of its elements, as well as for delays in the delivery of the boat. If the vessel suffers any damage, THE CHARTERER shall retain the deposit until receiving the amount corresponding to the indemnity from the insurance, the cost of the excess being at THE CHARTERER'S expense.
SECOND.- THE HIRER, in the event that any member of his crew or he himself suffers an accident on board the vessel, must inform THE LESSOR, by means of a written accident report, of the causes, circumstances and consequences of what happened, as well as, if known, the name, surname and address of the person who caused the accident and of the witnesses, and also the names and addresses of the injured parties, if any. For the purposes of this contract, accident shall be understood to be any fortuitous, spontaneous, external, violent and independent of the will of the person who suffers it and which occurs to any of the occupants of the vessel.
THIRD: If the present contract is cancelled for reasons attributable to the HIRER, the cost of the cancellation of a reservation shall be 20% of the total rental, if it occurs 60 or more days prior to embarkation, 40% between 60 and 30 days prior to embarkation and 60% if it occurs within 30 days prior to embarkation.
FOURTH.- Cancellation or change due to weather conditions, only the departure can be cancelled with the right to change the day, if possible, or to a refund of 80% of the total amount of the rental.
FIFTH: For any interpretation of the present contract, only the Courts of Ibiza shall have jurisdiction, and both parties waive any other jurisdiction that may correspond to them.
And in proof of conformity, the parties, in their respective interventions, sign the present contract in knowledge and approval of the clauses, in duplicate and to a single effect.
