Allgemeine Reservierungsbedingungen
Nachdem der VERMIETER den Zustand des Bootes, den Treibstoff und andere Ausgaben, die während des Charters entstanden sind, überprüft hat. Der Mieter verpflichtet sich, das Boot vollgetankt an den Vermieter zurückzugeben oder den Differenzbetrag zu zahlen + für den Fall, dass das Boot OHNE SKIPPER gemietet wurde, wird die Strafe für die Nichtrückgabe ..............,-€ betragen. Für jede Stunde Verspätung bei der Übergabe des Bootes.
VORAUSSETZUNGEN :
ERSTENS: Der Mieter verpflichtet sich, das gemietete Boot so zu benutzen, als ob es sein Eigentum wäre, in Übereinstimmung mit den Regeln der guten Seemannschaft und unter Beachtung der Vorschriften des Marinekommandos. Der MIETER ist verpflichtet, das gemietete Boot und alle darauf befindlichen Einrichtungen in einem guten Gebrauchszustand zu halten.
Der MIETER verpflichtet sich, an Bord des gemieteten Bootes nur die zugelassene Anzahl von Personen zu befördern. Das Boot, das Gegenstand dieses Vertrages ist, soll für die Freizeitschifffahrt genutzt werden und darf nicht für kommerzielle oder lukrative Zwecke eingesetzt werden.
DER MIETER verpflichtet sich, mit dem Schiff, das Gegenstand dieses Vertrages ist, nicht an Regatten oder sportlichen Wettkämpfen teilzunehmen. Das Schiff darf nur innerhalb der spanischen Hoheitsgewässer fahren.
DER MIETER verpflichtet sich, das Schiff nicht ohne Personen an Bord auf Reede oder in ungeschützten Gewässern, für die keine Liegegebühren zu entrichten sind, vor Anker liegen zu lassen.
Der Mieter verpflichtet sich, das vertragsgegenständliche Schiff nicht unter dem Einfluß von alkoholischen Getränken, toxischen oder narkotischen Drogen zu steuern und keine illegalen Substanzen an Bord zu nehmen.
Der MIETER haftet für alle Schäden am gemieteten Boot, die durch nicht von Dritten zu vertretende Ursachen verursacht werden, sowie für den Verlust von Bestandteilen des Bootes und für Verzögerungen bei der Übergabe des Bootes. Im Falle eines Schadens am Boot behält der Vermieter die Kaution ein, bis er den Betrag erhält, der der Entschädigung durch die Versicherung entspricht, wobei die Kosten der Selbstbeteiligung zu Lasten des Vermieters gehen.
ZWEITENS: Der MIETER ist verpflichtet, im Falle eines Unfalls, den ein Mitglied seiner Besatzung oder er selbst an Bord des Schiffes erleidet, den VERMIETER durch einen schriftlichen Unfallbericht über die Ursachen, die Umstände und die Folgen des Geschehens zu unterrichten sowie, falls bekannt, den Namen, den Vornamen und die Anschrift des Unfallverursachers und der Zeugen sowie gegebenenfalls die Namen und Anschriften der Geschädigten anzugeben. Als Unfall im Sinne dieses Vertrages gilt jeder zufällige, spontane, von außen kommende, gewaltsame und vom Willen der Person, die ihn erleidet, unabhängige Vorfall, der einem der Insassen des Schiffes widerfährt.
DRITTENS: Wird der vorliegende Vertrag aus Gründen storniert, die der MIETER zu vertreten hat, betragen die Kosten für die Stornierung einer Reservierung 20 % des Gesamtmietpreises, wenn sie 60 oder mehr Tage vor der Einschiffung erfolgt, 40 % zwischen 60 und 30 Tagen vor der Einschiffung und 60 %, wenn sie innerhalb von 30 Tagen vor der Einschiffung erfolgt.
VIERTE.- Stornierung oder Änderung aufgrund von Wetterbedingungen, nur die Abfahrt kann mit dem Recht auf den Tag zu ändern, wenn möglich, oder auf eine Erstattung von 80% des Gesamtbetrags der Miete storniert werden.
FÜNFTE - Für die Auslegung des vorliegenden Vertrages sind ausschließlich die Gerichte von Ibiza zuständig, und beide Parteien verzichten auf jede andere Zuständigkeit, die ihnen zustehen könnte.
Zum Beweis der Übereinstimmung unterzeichnen die Parteien den vorliegenden Vertrag in Kenntnis und Zustimmung der Klauseln in zweifacher Ausfertigung und mit einmaliger Wirkung.
